Terms of Service

1. Acceptance

By accessing, downloading, or using Skyfall Armada (the "Service"), you accept these Terms of Service, our Privacy Policy, Refund Policy, AI Disclaimer, and Report Abuse policy. If you do not agree, do not use the Service.

2. Audience

Skyfall Armada is designed for players of all ages. Combat is stylised arcade sci-fi action with no gore, profanity, sexual content, or real-world political violence. Younger players should have a parent or guardian agree to these Terms on their behalf.

3. License

We grant you a personal, revocable, non-transferable, non-exclusive license to use the Service for personal, non-commercial entertainment. You may not reverse engineer, redistribute, resell, or scrape the Service.

4. Membership & Paid Features

Where paid features exist, they are provided on a per-purchase basis. Access continues until cancelled, lapsed, or terminated under these Terms.

5. Prohibited Use

  • No illegal content of any kind. We have a zero-tolerance policy for content depicting minors in any sexual or exploitative context (CSAM), credible threats, or incitement to violence.
  • No harassment, hate speech, doxxing, or unlawful targeting of any person or group.
  • No use of the Service to develop competing products, train ML models, or scrape assets.
  • No attempts to bypass security, rate limits, or access controls.

6. User Conduct & Content

You are responsible for everything you submit through the Service. We may remove content and suspend accounts at our discretion to keep the Service safe and lawful.

7. AI-Generated Content

Parts of the Service generate text, audio, music, and imagery using AI. See our AI Disclaimer. AI output is not professional advice and may contain errors.

8. Third-Party Services & Affiliate Links

The Service may link to third-party retailers (including Amazon) through affiliate programs. We may earn a commission from qualifying purchases. We do not control third-party content, prices, or availability.

9. Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill.

10. Australian Consumer Law & Statutory Rights

Our goods and services come with guarantees that cannot be excluded under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by law that cannot lawfully be excluded.

To the maximum extent permitted by law, our liability for breach of a non-excludable consumer guarantee is limited, at our option, to re-supplying the service or paying the cost of re-supplying the service. Any provision of these Terms that conflicts with a non-excludable right is read down to the minimum extent necessary to be valid.

11. Termination

We may suspend or terminate your access at any time for breach of these Terms or to comply with law. Sections that by their nature should survive termination (IP, liability, governing law) will survive.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.

13. Severability & Entire Agreement

If any provision is held invalid, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, Refund Policy, AI Disclaimer, and Report Abuse policy, constitute the entire agreement between you and Nexus Systems regarding the Service.

14. Changes

We may update these Terms from time to time. Material changes update the "Last updated" date. Continued use after changes constitutes acceptance.
